Website Terms
Terms and Conditions
These terms govern your access to and use of The Standard by Sha website. By using the website, you agree to use it lawfully and in a way that does not interfere with its security, availability, operation, or the rights of another person.
You must not attempt unauthorised access, introduce malicious code, misuse website content, or use automated extraction tools except where permitted by law. We may reasonably restrict access where necessary to protect the website, our business, or other users.
Website content provides general information about our business development, brand, digital, e-commerce, CRM, ERP, and operational services. It may be updated as our services and practices change.
02
Enquiries
Enquiries and Service Engagements
Submitting an enquiry, requesting information, or communicating with us through this website does not create a client relationship, services contract, quotation acceptance, or obligation for us to provide services.
If we agree to provide services, the applicable proposal or services agreement will set out the scope, deliverables, complete fees, payment schedule, timing, client responsibilities, third-party costs, revision process, variation process, cancellation arrangements, and termination rights. Paid work begins only after the relevant engagement terms have been accepted.
You are responsible for ensuring that information supplied in an enquiry is accurate and that you have authority to provide it. Please do not submit passwords, payment-card details, government identifiers, sensitive personal information, or confidential information belonging to another person unless we have specifically requested it through an appropriate secure process.

Australian Consumer Law
Consumer Guarantees and Service Concerns
Nothing in these Website Terms or any applicable services agreement excludes, restricts, or modifies any rights, consumer guarantees, warranties, or remedies that cannot lawfully be excluded under the Australian Consumer Law.
Australian Consumer Law guarantees may apply to services we later agree to supply, including services acquired by some business customers. Depending on the circumstances, these guarantees can include that services are provided with due care and skill, are fit for a disclosed purpose, and are supplied within a reasonable time where no timeframe has been agreed.
This website does not take payment or sell services online, so it does not publish a standalone refund policy. Cancellation, rescheduling, deposits, fees, and work already performed will be addressed in the applicable services agreement. We will assess concerns promptly and provide any remedy required by law. We do not use these terms to deny a remedy available under the Australian Consumer Law.

Important Information
Disclaimer and No Guaranteed Outcomes
Website information is general in nature and is not tailored legal, financial, tax, accounting, regulatory, or other specialist advice. You should obtain appropriately qualified advice before acting on information where your circumstances require it.
Business outcomes depend on many factors outside our control. Unless expressly agreed in a written services agreement, we do not guarantee revenue, profit, leads, search rankings, conversion rates, platform approval, campaign performance, operational savings, e-commerce results, integration outcomes, funding, or a particular completion date.
Case studies, testimonials, examples, forecasts, and past outcomes illustrate particular experiences. They do not promise that another business will achieve the same result. Any estimate or forward-looking statement is subject to the assumptions and qualifications provided with it.
We take reasonable care when preparing website content, but do not promise that the website will always be available, uninterrupted, error-free, secure, or free from harmful code. Nothing in this disclaimer limits liability that cannot lawfully be limited.

Privacy Notice
How We Handle Personal Information
When you submit an enquiry, we collect the information you provide, which may include your name, email address, optional phone number, business name or website, business stage, service and offer interest, optional investment and timing information, and message. If you request a readiness summary, we also record your selected assessment answers. We use it to respond, understand your business needs, assess relevant services, prepare a proposal where requested, and manage our relationship with you. If required information is not provided, we may be unable to respond or assess the enquiry.
We may use service providers that support our website, forms, hosting, email, customer relationship management, analytics, information technology, and professional operations. They may handle personal information only to the extent necessary to provide those services. Some providers may process information outside Australia. Where Australian privacy law applies, we take reasonable steps required by law in relation to those arrangements.
We do not treat an enquiry as consent to ongoing promotional email or SMS marketing. Email insights and service-update subscriptions are optional and separate from enquiries and requested assessment summaries. We record the selected permission, time, source and wording version. Use the unsubscribe link in a promotional message or contact us to withdraw permission. Commercial electronic messages will identify the sender and provide a functional unsubscribe method as required by law.
We record the enquiry capture page, campaign landing page and campaign labels where supplied so we can understand which services attract suitable enquiries. We retain a minimal email preference and consent-history record when you unsubscribe to avoid accidentally adding you back to promotional outreach. A later enquiry without marketing permission does not remove that suppression.
We take reasonable technical and organisational steps to protect personal information and retain it only for legitimate business or legal purposes. You may ask to access or correct personal information we hold, or make a privacy complaint, by emailing us. We will assess the request and respond within a reasonable period.
07
Ownership
Intellectual Property
Original website text, design elements, photographs, graphics, videos, templates, code, and other material owned by or licensed to The Standard by Sha are protected by applicable intellectual-property laws.
You may access and view the website for lawful personal or business information purposes. You must not copy, adapt, distribute, commercialise, frame, publish, or create derivative works from our material without written permission, except to the extent permitted by law.
Client logos, trade marks, platform marks, stock assets, open-source components, and other third-party materials remain the property of their respective owners and are used with permission or under applicable licence terms where required.
08
External Services
Third-Party Links and Platforms
Links to external websites, platforms, social-media services, and third-party resources are provided for convenience. Unless expressly stated, we do not control, endorse, sponsor, adopt, guarantee, or warrant third-party content, availability, security, or privacy practices.
Your use of an external service is governed by that provider's terms and privacy practices. References to technology providers or platforms do not promise a particular result from their products or services.
09
Legal Limits
Liability
To the maximum extent permitted by law, we exclude or limit only liability that may lawfully be excluded or limited. Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Any service-specific allocation of risk, responsibility for third-party platforms, client dependencies, insurance requirements, or agreed liability limits will be addressed in the applicable proposal or services agreement and remains subject to mandatory law.
10
Administration
Changes, Governing Law, and Contact
We may update this page when our website, services, practices, or legal obligations change. The effective date below identifies the current version. Material changes will apply prospectively and will not replace agreed service terms without an appropriate variation process.
These Website Terms are governed by the laws applicable in Australia and, where relevant, the Australian state or territory from which the services are principally supplied. Courts with lawful jurisdiction may hear disputes. Mandatory consumer and other non-excludable laws continue to apply.
For legal, privacy, access, correction, or complaint enquiries, contact sha@thestandardbysha.com. Please include enough information for us to understand and respond to your request.
